Usage & Compliance Policy

This policy is part of our Terms of Service. Every account accepts it at signup, and it applies to every call placed through kolz ai.
1. What you accept at signup
When you create an account you tick a box confirming the following. We record the confirmation, the exact wording, the time and the IP address it came from.
1. Consented lists only
Every number you upload has given you prior express consent to receive promotional or marketing calls, and you can produce proof of that consent on request.
2. Call only those numbers
You will only place calls to numbers on those consented lists. No purchased, scraped, or borrowed data, and no calls to anyone who has asked you to stop.
3. Follow the calling guidelines
You will follow our published calling guidelines (identify yourself, honour opt-outs immediately, respect calling hours and volume limits) so your traffic is not flagged as spam.
The statement on file reads: “I confirm that every number I upload has given prior express consent to receive promotional calls, that I will only call numbers on those consented lists, and that I will follow the kolz ai calling guidelines. I accept the Usage & Compliance Policy and the Terms of Service.”
2. Consent is your responsibility
kolz ai places calls on your instruction. We do not supply, verify, or vouch for the numbers you upload, so the legal basis for calling them is yours to hold:
- Prior express consent: where the law requires it (for example prior express written consent for automated or pre-recorded marketing calls to US numbers under the TCPA), you must have obtained it before uploading the number
- Records: keep evidence of each consent (source, timestamp, wording shown, IP or signature) for at least the period required in your jurisdiction, and produce it within 5 business days if we ask
- Scope: consent must cover the type of call you are making and your business specifically, not a third party who collected the lead
- Freshness: do not rely on stale consent. Re-confirm where consent has expired or the contact has been inactive for a long period
- No purchased or scraped data: bought lists, scraped numbers, and lists you did not collect or licence with consent are not permitted
- Scrubbing: scrub against the applicable Do Not Call registries and your own internal suppression list before every campaign
You may only call the numbers on those consented lists. Calling anyone else through the platform, including manual test calls to people who did not opt in, is a breach of this policy.
3. Calling guidelines
These are the rules that keep your caller ID out of spam databases and keep your answer rates alive. They are requirements, not suggestions.
- Identify yourself immediately: your agent must state your business name in the opening line and say why it is calling
- Disclose the AI: where required by law, and as good practice everywhere, make clear the caller is an automated assistant
- Honour opt-outs on the spot: if someone says stop, do not call, or asks to be removed, the call ends and the number goes on your suppression list permanently. Never call it again from any campaign
- Calling hours: stay inside the permitted local calling window for the number you are dialling (8:00am to 9:00pm local time in the US, stricter where local law says so)
- Attempt limits: no more than a reasonable number of attempts per contact per campaign, and no re-dialling a number that has already declined
- Accurate caller ID: use a number you own or are authorised to use, that is registered to your business and reaches a working line. No spoofing, no neighbour-spoofing, no rotating unregistered numbers to dodge flags
- Warm up volume: ramp new numbers gradually rather than launching a large campaign on a fresh number, and spread volume across the day
- Register your traffic: complete the branded-caller or number-registration steps applicable in your market so carriers can attribute your calls
- Keep the script honest: no misrepresenting who you are, what you are offering, or the terms. No pressure tactics, no impersonating a government body, bank, or other business
- Watch your own metrics: high hang-up rates, short average durations and complaints are the leading indicators of a flag. If yours spike, pause and fix the list or the script

4. Prohibited use
You may not use kolz ai to:
- Call numbers that did not consent, including purchased, scraped, or reassigned numbers
- Call anyone who has opted out, or anyone on an applicable Do Not Call registry without a valid exemption
- Run scams, phishing, debt-collection harassment, fake charity or fake government calls
- Impersonate a person, business, or authority, or display caller ID you are not authorised to use
- Deliver political, medical, financial, or other regulated messaging without the licences and consents that category requires
- Evade spam filtering or carrier analytics through number rotation, spoofing, or similar techniques
- Resell platform access, or place calls on behalf of a client who cannot meet this policy
5. Enforcement
We monitor for complaint spikes, carrier flags, and abnormal campaign patterns. If we believe an account is breaching this policy we may, without notice:
- Pause a running campaign or throttle an account
- Require you to produce your consent records for the list in question
- Suspend or terminate the account, with unused credits forfeited
- Cooperate with carriers, regulators, and law enforcement, including disclosing your account and campaign records where legally required
You remain responsible for the calls made from your account. As set out in the Terms of Service, you indemnify Kolz Inc. against claims, fines, and costs arising from your calling activity, including claims brought under the TCPA or equivalent laws.
6. Changes to this policy
This policy is versioned. If we change it in substance we publish a new version and ask you to accept it the next time you open your dashboard. Continued use after a new version takes effect requires that acceptance.
kolz ai is a technology platform and does not provide legal advice. Telemarketing law varies by country, state, and industry. Consult your own counsel to confirm what applies to your campaigns.
